Exceptions to the use and disclosure offences

72.11 The exceptions under Part 13 of the Telecommunications Act provide for a range of circumstances in which carriers and carriage service providers may use or disclose information. It has been argued that many of the exceptions are unnecessarily broad and do not provide a sufficient level of protection of personal information in the telecommunications industry.[12] This section of the chapter considers whether the scope of some of the exceptions under Part 13 should be confined, or aligned with similar exceptions under the Privacy Act.
