Introduction

56.1 This chapter discusses the existing provisions of Part IIIA of the Privacy Act 1988 (Cth) dealing with the collection (and notification of collection) of information in credit information files and credit reports. Recommendations are made on how these matters should be dealt with under the Unified Privacy Principles (UPPs)[1] and the new Privacy (Credit Reporting Information) Regulations.

56.2 The issues in this chapter and Chapters 57–58 are discussed broadly in the order the privacy principles are set out in the model UPPs. Where applicable, the provisions of the UPPs and Part IIIA of the Privacy Act are compared briefly.
