Introduction

59.1 In this chapter, the ALRC discusses the existing provisions of Part IIIA of the Privacy Act 1988 (Cth) dealing with an individual’s rights of access to, and correction of, credit reporting information. Recommendations on how these matters should be dealt with under the model Unified Privacy Principles (UPPs)[1] and the new Privacy (Credit Reporting Information) Regulations are made.

59.2 The chapter also examines complaint handling in credit reporting disputes by the Office of the Privacy Commissioner (OPC) and other complaint-handling bodies and processes. Penalties for breach of the new regulations are also discussed.
