When you make a submission, please tell us if: 

  • you have personal experience of surrogacy, for example as a surrogate, intended parent, parent through surrogacy, or person born through surrogacy. The ALRC will de-identify all submissions from people with personal experience of surrogacy (see below). 
  • you would like your submission to be confidential — this means it will not be published online, and your name will not be included in our list of submissions. 

If you do not specify, we will treat your submission as a public submission, subject to any laws that apply and our submission policy.       

We want to encourage submissions from people who have personal experience of surrogacy. This includes surrogates, intended parents, parents through surrogacy, and people born through surrogacy. However, some Australian laws prohibit the identification of people involved in surrogacy arrangements or family court proceedings. For this reason, we will de-identify all submissions which identify, or may identify, people involved in surrogacy arrangements. This means it will be published online, but anonymised — we will remove your name, the names of anyone else mentioned in the submission, and any other identifying details before we publish it. If we determine that your submission does not need to be de-identified, we will ask for your consent before publishing it.  

We will only disclose identifying information outside the parameters above if the law or a court tells us to do so. Given ‘commercial’ surrogacy is illegal is some jurisdictions, when making a submission you may want to consider whether you are disclosing information that might expose you, or others, to legal risks or consequences.
