Community Law Reform for the Australian Capital Territory: Third Report - Occupiers' Liability (ALRC 42)

The terms of reference for the Community Law Reform Program for the ACT, received in July 1984, allowed the Australian Law Reform Commission to identify areas in need of reform and recommend that the Attorney-General issue the Commission with a reference on that subject.

One such area was the law governing the liability of the occupiers of property for damage or injury caused to visitors. This law regulated the degree of care expected of people in control of land to protect those who enter the premises.

A Discussion Paper, Occupiers' Liability (DP 28), was released in 1987 and the final report, Occupiers' Liability (ALRC 42), was tabled in federal Parliament in April 1988.

There has been substantial implementation of the recommendations in ALRC 42.
